The matter was passed over on the first call at the request of learned counsel for the petitioner. On the second call, learned counsel for the petitioner states that in the light of a recent judgment of the Supreme Court dated 27.03.2019, passed in Crl.A 538-539/2019 titled as SFIO Vs. Rahul Modi & Another Etc., he does not wish to press prayer (a). 2.
On the last date of hearing, we had clearly indicated to the learned counsel for the petitioner that in view of the fact that the Supreme Court is seized of the issue raised by the petitioner in the present petition, subject W.P.(CRL) 385/2019
matter of prayers (b) and (c), in SLP (Crl.) 9360/2018 titled as "The Directorate of Enforcement vs. Karti P. Chidambaram", judicial propriety demands that we refrain from hearing arguments on the said issue and await a decision by the Supreme Court.

Learned counsel for the petitioner states that in view of the judgment of the Supreme Court in the captioned appeal and further, having regard to the fact that the Supreme Court has yet to decide the pending SLP (Crl.) 9360/2018, he has instructions to withdraw the present petition while reserving the right of his client to approach the competent court vested with jurisdiction, for the remaining relief, as may be permissible in law. 4.
Leave, as prayed for, is granted.
The petition is disposed of along with the pending application.
