% 27.01.2020 CM No.3219/2020 1.

Allowed, subject to just exceptions.

W.P.(C) No.998/2020 & CM No.3218/2020 2.

Issue notice.

2.1 Mr. Relan accepts notice for respondent No.1, while Mr. Aggarwal accepts notice for respondent No.2 to 4.

3.

Mr. Relan, at the outset, submits that the date of auction has been extended to 17.2.2020 and therefore, there is no urgency in the matter. 4.

Mr. Relan further submits that the representation preferred by the petitioner, which is dated 13.1.2020, will be decided within ten days. W.P.(C) 998/2020 1/2

5.

Mr. Sengh, learned senior counsel, who appears for the petitioner association, says that if the writ petition is disposed of with a direction to the DDA that the representation be decided within the timeframe indicated above by Mr. Relan, alebit, by way of a speaking order, for the moment, it would satisfy the petitioner.

6.

I have perused the petition. It appears that at least some issues raised in the writ petition, even according to the petitioner, are of general public interest.

7.

That being said, in view of the statement made by Mr. Relan, this writ petition is disposed of with a direction to the DDA to decide the aforementioned representation of the petitioner within ten days from the date of receipt of a copy of the order.

8.

The petitioner will be given via its authorized representative a personal hearing in the matter. For this purpose, the authorized representative of the petitioner will appear before the Commissioner (Land & Development), DDA on 31.1.2020 at 11.00 A.M. The Commissioner (Land & Development) will, thereafter, pass a speaking order; a copy of which will be furnished to the petitioner.

9.

Needless to add, the petitioner will have liberty to assail the same, as per law, in case the order passed adversely impacts its interest. 10.

Resultantly, pending application shall stand closed. 11.

Dasti under signatures of the Court Master.
