CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 27.01.2020 CM APPL. 3237/2020 1.

Allowed, subject to just exceptions.

W.P.(C) 1010/2020 & CM APPL. 3236/2020 2.

After some arguments, learned counsel for the petitioner says that the Petitioner will take recourse to the provisions of Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (in short "2002 Act") to ventilate its grievance. 3.

Learned counsel says that this Court could direct the concerned DRT to take up the matter at the earliest since there is a threat of possession of the secured asset.

4.

The writ petition is dismissed as withdrawn with the direction to the concerned DRT to take up the matter for hearing (and, if not for final W.P.(C) 1010/2020 1/2

Disposal), for grant of interim relief in case the petitioner files a petition under Section 17 of the 2002 Act within the next two days. 5.

Dasti under signatures of the Court Master.
