Exemption is granted, subject to all just exceptions. 2.

The Applicant shall file legible and clearer copies of exempted documents, compliant with practice rules, before the next date of hearing. 3.

Accordingly, the application stands disposed of. CRL.M.(BAIL) 1771/2025 (seeking interim bail for ten days between 21st August, 2025 to 31st August, 2025) 4.

Through this application, the Applicant seeks interim bail for a period of 10 days in the proceedings arising from FIR No. 117/1996, P.S. Vivek Vihar under Sections 302/354 IPC, pending consideration of his application seeing furlough. It is stated that the Applicant is suffering from low haemoglobin levels and reduced blood count, resulting in severe anaemia. is further submitted that, pursuant to this condition, the Applicant is required to consult a doctor at the All India Institute of Medical Sciences,1 for which an appointment is scheduled tomorrow, i.e., on 22nd August, 2025. 5.

Ms. Vrinda Bhandari, counsel for the Applicant, submits that the appointment request was made on 23rd July, 2025, while the Applicant was on parole, and that the appointment was scheduled nearly a month later. She further submits that if the Applicant is not permitted to consult the doctor as scheduled, the appointment would have to be rescheduled, resulting in further delay in his treatment.

As per the latest nominal roll on record, the Applicant has been in custody for a period of 16 years, 10 months and 6 days as on 7th April, 2025. He has further earned remission of 3 years, 7 months and 21 days. The Applicant's overall conduct as well as jail conduct for the last one year have both been noted as satisfactory.

In light of the foregoing, and having regard to the exceptional circumstances arising from the Applicant's immediate medical appointment, the Court is inclined to grant limited relief purely on humanitarian grounds. To balance the risk associated with releasing the Applicant on interim bail, the Court finds it appropriate to grant custody parole, thereby enabling the Applicant to attend his medical appointment without compromising the interests of justice or public safety 8.

Accordingly, the Superintendent, Central Jail, is directed to make necessary arrangements for escorting the Applicant to AIIMS Hospital for his appointment scheduled tomorrow, i.e., on 22nd August, 2025. The custody parole shall be operative for a period of one day. However, in the 1 "AIIMS"

event that the Applicant is required to visit the hospital again the next day, the custody parole shall be extended accordingly to enable him to undergo further treatment. During this period, the Applicant shall be permitted to consult with doctors and make all requisite arrangements for his medical care.

As regards the Applicant's pending application for grant of furlough, the Respondent is directed to take a decision thereon, within a period of one week from today.
