Swaminarayan B.Ed. College v. National Council For Teacher Education And ANR.
$~38 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 1008/2020 SWAMINARAYAN B.ED. COLLEGE ..... Petitioner Through:
Mr. Mayank Manish and Mr. Ravi Kant, Advs.
versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR. ..... Respondents Through:
Ms. Niharika Rai, Adv. for NCTE.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 27.01.2020 1.
The principal grievance of the petitioner is that the Appeal Committee of the NCTE has remanded the matter to the Western Regional Committee (WRC) vide its order dated 12.9.2018.
2.
There has been no substantial movement in the matter although a show case notice was issued, to which, the reply was filed by the petitioner. 3.
The record shows that WRC issued a show case notice dated 19.11.2018 pursuant to the remand order passed by the Appeal Committee. 4.
The record also shows that the petitioner filed a reply to the said show cause notice. This reply is dated 14.12.2018. A copy of the reply is appended on page 46 of the paper book and is marked as annexure P-4. 5.
It appears that thereafter the petitioner has sent two reminders to the WRC. These reminders are appended on pages 48 and 50 of the paper book. W.P.(C) 1008/2020 1/2
6.
Given these circumstances, the WRC is directed to take a decision as to whether or not the order passed by it earlier i.e. the order dated 2.11.2017 ought to be recalled or not. Via this order, the petitioner's recognition for conducting B.Ed. course with an annual intake of 50 students was withdrawn.
7.
Accordingly, the writ petition is disposed of with a direction to the WRC to adjudicate upon the show cause notice dated 19.11.2018 at the earliest.
8.
The WRC will endeavour to take up the petitioner's case in the next meeting which it convenes following the receipt of a copy of the order. RAJIV SHAKDHER, J JANUARY 27, 2020 rb W.P.(C) 1008/2020 2/2
