Learned counsel appearing on behalf of the petitioner submits that the petitioner be permitted to withdraw the present Petition since it suffers from a technical defect of no Notice having been served, under Section 21 of the Arbitration and Conciliation Act. Liberty is sought to file afresh on the same cause of action.

Learned counsel for the respondent has "No Objection" to the withdrawal of the Petition.

In view of the submissions made, the Petition is permitted to be withdrawn with liberty as prayed.
