% 27.01.2020 I.A.No.1115/2020 (for exemption) Exemption allowed, subject to all just exceptions. O.M.P.(MISC.)(COMM.) 35/2020 1.
This is a petition filed under Section 29(A)(4) of the Arbitration and Conciliation Act, 1996 seeking extension of time for conclusion of the arbitration proceedings and passing of the award. 2.
Learned counsel for the petitioner submits that the learned Arbitrator had entered reference upon being appointed vide this Court's order dated 24.05.2017. Though time for completion of arbitration proceedings and rendering the award was extended by this court on two earlier occasions, the mandate of the learned Arbitrator has expired on 10.01.2020 but the proceedings are still ongoing. She further submits that after the parties had made final submissions, the matter was listed before the learned Arbitrator on 08.01.2020, on which date the same was adjourned to 24.01.2020 for certain
clarifications from the parties. She, therefore, prays that the period for rendering the award be suitably extended by at least two months. 3.
Issue notice. Learned counsel for the respondent accepts notice and fairly does not oppose the petition.
4.
Accordingly, with the consent of the parties, the time for conclusion of the arbitration proceedings and passing of the award is extended for a further period of three months commencing from 11.01.2020.
5.
The petition stands disposed of in the aforesaid terms. REKHA PALLI, J JANUARY 27, 2020/sr
