Mr. Kirtiman Singh has returned with instructions. In this connection, a copy of the letter dated 2.2.2018 addressed by Mr. K.S. Kalsi Colonel Director (SE) for DG (R) addressed to GBS Coal Carriers Pvt. Ltd. is placed before me.

1.1 A copy of this letter has also been furnished to the counsel for the petitioners.

1.2 In consonance with paragraph-3 of this letter Mr. Kirtiman Singh says that three directors will be appointed to the Board of the company i.e., GBS Coal Carriers Private Ltd on or before 19.3.2018. Insofar as the two directors, who are presently on the Board of the said company i.e., Lt. Col. Jaivir Singh (Retd) and Lt. Col. GBS Kang (Retd), the letter indicates that their cases for disempanelment are being enquired into, on the ground that they have had access to dual income.

Accordingly, the writ petition is disposed of with the

direction to the respondents to ensure that at every given point of time, in accordance with their guidelines, three directors are in position on the Board of GBS Coal Carriers Private Ltd. 3.
