The present application has been filed by the petitioner under Section 151 Code of Civil Procedure, 1908 ("CPC") for seeking permission to withdraw the present matter.

Learned counsel appearing for the petitioner submits that during the pendency of the present matter, the respondent-Municipal Corporation of Delhi ("MCD") has already taken action against the unauthorized construction in question.

Issue notice. Notice is accepted by Ms. Puja Kalra, learned Standing Counsel for the MCD.

She submits that action was taken by the MCD on 6th March, 2024. She submits that further action is also slated for 24th April, 2024. submits that the MCD has no objection, if the present petition is allowed to be withdrawn.

Accordingly, noting the aforesaid facts, the present application is allowed and the petitioner is allowed to withdraw the present petition. 6.
With aforesaid directions, the present application is disposed of. CONT.CAS(C) 354/2024 7.
The present petition is dismissed as withdrawn, in view of the order passed in CM APPL. 21667/2024.
