It is submitted by the Appellants that they do not want to pursue the appeal anymore inasmuch as through the impugned judgment dated 19.09.2004 and the order in sentence dated 30.09.2004, they were held guilty, convicted and instead of sending them to prison the benefit of probation was extended to them and they were released on a bond of probation for 02 years, bonds were furnished by them. 3.

During those 02 years of probation, nothing untoward happened which may warrant any exacerbation and now that the period is long over therefore, it would not serve any purpose to pursue the appeal, and such may be permitted to withdraw the same.

SI Mukesh Kumar is present but he was not the Investigating Officer, therefore, is unable to identify them, nevertheless in view of the aforesaid circumstances, the appeals stands dismissed as withdrawn. 6.

The appeals stand disposed of accordingly.
