Petitioners seek quashing of case FIR No. 1277/2017 of PS Vijay Vihar for offence under Section 498A/406/34 IPC on the ground that complainant de facto (respondent no.2) has compromised the disputes with the petitioners.

Learned APP for the State accepts notice and submits that State has no objection.

I have spoken with both sides in Hindi and it is stated by them that now they have compromised all their disputes and are living together happily. Petitioner no. 1 is husband of respondent no. 2 and petitioners no. 2 and 3 are mother and brother of petitioner no. 1, respectively. It is further submitted by all of them that for past six years they are living together and the petitioner no. 1 and respondent no. 2 are bringing up their two daughters also. The respondent no. 2 submits that she does not wish to continue with prosecution of petitioners.

Having spoken with both sides, I am satisfied that it would be in the interest of justice not to push the parties through a full dress trial. 6.
Therefore, the petition is allowed and FIR No. 1277/2017 of PS Vijay Vihar for offence under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed.

Accompanying application also stands disposed of.
