% 22.01.2016 I.A. No. 18702/2012 This application has been moved to seek modification/ correction of the order dated 12.01.2012 passed in I.A. No. 2521/1995. It is pointed out that the said application has been preferred under Order XXXIX Rules 1 & 2 CPC, on which interim orders have been passed by the Court. On the said date, on account of a wrong noting, the said application was assumed to be one under Section 149 read with Section 151 CPC, and consequently, the Court dismissed the application as infructuous. Learned counsel for the defendant does not dispute this course of position.

Accordingly, the order dated 12.01.2012 passed in I.A. No. 2521/1995 is recalled. The said application is still pending.

CS(OS) 675/1995 and I.A. Nos. 2521/1995 & 14775/2011 In view of the notification No.2718/DHC/Orgl. dated 25.11.2015, issued under Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), at the request of the counsels for the parties, the present suit is transferred to the Court of the District Judge (South-East), Saket Courts for further proceedings before the competent court on 02.05.2016. It is made clear that as both sides are duly represented today, no fresh notice for appearance shall be issued and the parties shall ensure their presence before the concerned Court on the aforesaid date.
