O R D E R

The present petition has been filed by the petitioner, inter alia, seeking as follows:- "a. Allow the present petition and thereby issue a writ of mandamus or any other appropriate writ, order or direction directing the Respondent No.1 to pay to the Petitioner an amount of Rs. 10,26,53,067/- (Rupees Ten Crore Twenty-Six Lacs Fifty-Three thousand and Sixty-Seven only) along with interest at the rate of 18% per annum" 2.

Learned counsel for the petitioner submits that during the pendency of the present petition, the petitioner has invoked the relevant arbitration clause in the agreement entered into between the parties, and the arbitral proceedings are also underway.

In the said arbitration proceedings, the petitioner has also moved an application for impleading the Employee State Insurance Corporation (respondent no.2); the same is pending consideration before the learned arbitral tribunal.

present petition and the same is accordingly disposed of, leaving it open to the petitioner to pursue the arbitral proceedings in accordance with law. 5.
