The Petitions under Section 482 CrPC have been filed on behalf of the petitioners to challenge the summoning order of learned Metropolitan Magistrate, Saket District Court (South), New Delhi, under Section 138 of the N.I. Act. This was the Order of 30.09.2019. The Petition suffers from delay and laches. Also, the petitioners have the alternative remedy to challenge it before the learned Sessions Court. The period during which the Petitions were pending in the Court, may be excluded, in accordance with law.
