The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers:

"(a) allow the present Petition; set aside the Impugned Order dated 08.02.2022 passed by Shri Virender Singh, ACJ-CumCCJ-Cum-ARC (North) Rohini Courts, Delhi in RC ARC No. 3618 [CNR No. DLNT03-001737-2018] titled as Smt. Jagjit Khanna Vs. Shri Taresh Sharma with costs throughout and the Petitioner be granted eviction of the Respondent from the suit property; and (b) pass any other further orders that it may deem fit and proper in the facts and circumstances of the present case;" 3.

Vide order dated 08.02.2022, learned ACJ-Cum-CCJ-Cum-ARC had allowed the application seeking leave to defend filed on behalf of the respondent and directed him to file a written statement. Learned counsel for the petitioner submits that the matter is presently at the stage of evidence, and on instruction, seeks leave to withdraw the present petition with a prayer for expeditious disposal of trial. 5.

In these circumstances, without prejudice to the rights and contentions of the parties, the present petition is dismissed as withdrawn and disposed of accordingly.

Learned ACJ-Cum-CCJ-Cum-ARC is requested to proceed with the trial without giving any undue adjournments to either of the parties and dispose of the same as expeditiously as possible, preferably within a year from today.
