The present appeal challenges the judgment of conviction and order on sentence dated 07.08.2003 and 08.08.2003 respectively, in Sessions Case No. 70/2002 arising out of FIR No. 101/01 under Sections 395/451/34 of the IPC, registered at P.S. Greater Kailash-I. The appellant had been convicted for offences under Sections 451/34 of the IPC and was sentenced to undergo RI for 5 years and for the offences under Sections 395/34 of the IPC and was sentenced to undergo RI for 7 years and fine of Rs. 500/- and in default SI for 3 months.

None has been appearing on behalf of the appellant and in pursuance of the notice issued through the SHO, it has come on record that the appellant is not residing at the given address. Nominal Roll dated 08.04.2024 has been placed on record wherein it reflects that the present appellant has been released from custody after serving the sentence awarded to him in the present case. Nominal roll further reflects that the appellant has been released from jail on 01.12.2010, after completion of sentence in the present case as well as the other cases mentioned in the said Nominal Roll.

In view of the above, the present appeal is dismissed in default for non-prosecution and disposed of accordingly.
