% 08.02.2016 Present writ petition has been filed with the following prayers:- a) Issue writ of Mandamus or any other appropriate writ or order or direction to respondent to grant relaxation to "other backward classes" (OBC) in upper age limit upto 5 years in Regulation 6; and b) Issue writ of Certiorari or any other appropriate writ, order and quash the order dated 13.02.2015 issued by the respondent; and c) Issue writ of Mandamus or any other appropriate writ, order or direction commanding the respondent to resume the grant of i.P. Research Fellowship (IPRF) to the petitioner in terms of a letter dated 10.12.2013 as well as pay the arrears; and/or d) Pass such other order/orders as deemed fit and proper by this Hon'ble Court in the facts and circumstances of the case."
The impugned letter dated 13th February, 2015 is reproduced hereinbelow:-
"This is to inform you that your Indraprastha Research Fellowship (IPRS) has been terminated w.e.f. 01.12.2014 due to overage, as per guidelines for availing IP Research Fellowship (IPRF) & Contigency Grant- "The upper age limit for IP Research Fellow shall be 30 years relaxable upto 5 years for SC/ST, woman and physically Handicapped Scholars."
Learned counsel for the petitioner states that the petitioner‟s termination of Indraprastha Research Fellowship is illegal, inasmuch as five years relaxation for SC/ST, woman and physically handicapped scholars is not extended to OBC scholars. A perusal of the file reveals that the petitioner as of today is 36 years of age. In the opinion of this Court, even if the petitioner were to be granted relaxation of five years beyond the age of 30 years, as given to SC/ST, woman as well as physically handicapped scholars, then also the petitioner as of today would not be entitled to Indraprastha Research Fellowship.
Consequently, the present writ petition is not maintainable and the same is accordingly dismissed along with the applications. MANMOHAN, J FEBRUARY 08, 2016 KA
