ARB.P. 92/2019 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Memorandum of Understanding dated 27.03.2014. The said MoU contains an Arbitration Agreement in form of Clause 12 thereof.

The learned counsel for the respondent, who appears on advance notice, submits that the respondent has no objection to the appointment of an Arbitrator.

In view of the above, I appoint Mr.Padam Kant Saxena, ADJ (Retd.) Delhi, (R/o Flat No. 261, Royal Residency, Plot No. 5, Sector- 9, Dwarka, New Delhi- 110077 Mobile: 9910384668) as a Sole Arbitrator for

adjudicating the disputes that have arisen between the parties in relation to the abovementioned MoU.

The Arbitrator shall give disclosure under Section 12 of the Act before proceeding with the reference.
