O R D E R

% 05.06.2018 In terms of proceedings dated 04.06.2018, the nominal roll has been submitted as received from the Superintendent Jail, Central Jail No.2, Tihar, New Delhi indicating that the appellant had undergone as on 23.12.2004 a period of 4 years, 9 months and 17 days of incarceration qua the sentence of Rigorous Imprisonment of 10 years and a fine of Rs.500/- and in default of payment of said fine, a period of 6 months of Rigorous Imprisonment qua the offence punishable under Sections 376/511 Indian Penal Code, 1860 in relation to FIR No.58/1999, PS JP Kalan.

On behalf of the State has been submitted the certificate of death as issued by the South Delhi Municipal Corporation indicating the demise of the appellant Ved Prakash @ Vedu, s/o Shri Sher Singh, r/o Village & Post Office Milak Pur, PS JP Kalan, New Delhi on the date 22.06.2017 with the demise having been registered on 06.07.2017. Along with the said death certificate is also the certificate

issued by the Medical Superintendent of the hospital concerned. The Investigation Officer of the case in reply to a specific Court query on solemn affirmation states that the person named Ved Prakash is the same as the person named Ved Ram @ Vedu, s/o Shri Sher Singh, the convict in relation to FIR No.58/1999, PS JP Kalan i.e. the appellant herein.

In view thereof, the proceedings against the appellant in the instant case abate.

His surety is discharged.
