The present petition has been filed by the defendant who is aggrieved by the interim order passed by the learned Trial Court on 13.02.2025 whereby there is interim restraint order with respect to execution of any further document qua one property situated at Cleo County, Noida, U.P. 2.

Learned counsel for the petitioner has, however, informed that thereafter, the matter was taken up by the learned Trial Court on 19.03.2025 and the learned Trial Court has already decided the application moved under Order XXXVIII Rule 5 CPC. Since such order is being challenged separately by the petitioner herein, it is prayed that the present petition, without prejudice to his rights and contentions, may be permitted to be withdrawn. 3.

The petition is, accordingly, disposed of as withdrawn. 4.
