This joint application is filed on behalf of the parties under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement arrived at between parties.

During the pendency of the present proceedings, parties have amicably settled their inter se disputes and have executed a Settlement Agreement on 28.08.2025, filed as 'Document 1' along with this application.

Court has perused the terms of the settlement and finds the same to be lawful.

Accordingly, the application is allowed recording the settlement between the parties.

This rectification petition is filed under Section 47 and 57 of The Trade Marks Act, 1999 on behalf of the Petitioner seeking rectification of the Register of Trade Marks by cancelling registration of mark 'HOUZER' registered in Class 36 under Registration No. 5834778 on 04.03.2023. 7.
In view of amicable settlement between the parties, it is directed that registration of trademark 'HOUZER' shall be cancelled and Register of Trade Marks will be accordingly rectified by the Registrar of Trade Marks within six weeks from today. Parties to the lis shall remain bound by all other terms of the settlement incorporated in the Settlement Agreement dated 28.08.2025.

Petition is disposed of in the aforesaid terms along with the pending application.
