Respondent No.1 has filed this application to bring on record a Settlement Deed dated 06.07.2024 ["Settlement Deed"], by which the disputes between the parties have been settled. The petitioner and respondent Nos.1 and 2 are all parties to the Settlement Deed. It records that several litigations are pending between the parties including O.M.P. (COMM) 86/2020, which is directed against an Arbitral Award dated 27.04.2010. The parties have settled their disputes and undertaken to file an application before this Court regarding the settlement, and also to be bound by it. Other litigations were to be withdrawn by the petitioner herein after disposal of the present petition. O.M.P. Mr. Ashwani Kumar Dhatwalia, learned counsel, appears on behalf of the petitioner on advance notice. All the parties are present in person and are identified by counsel.

Learned counsel for the parties confirm the settlement and undertake that the parties will be bound thereby. Learned counsel for respondent Nos.1 and 2 state that as recorded in the Settlement Deed, the impugned award shall be treated as null and void and not put into execution.

In view of the above, the award dated 27.04.2010 is set aside in terms of the Settlement Deed, and the petition is disposed of. 5.

All pending applications, if any, are disposed of. 6.
