This is an application filed by the defendant seeking leave to withdraw application bearing no. CRL. M.A. 9871/2023 in terms of the settlement agreement dated 30.09.2024 to which the parties to the suit are also parties.

The application is allowed and CRL. M.A. 9871/2023 is hereby dismissed.

CS(COMM) 166/2023 and I.A. 41682/2024 (on behalf of the plaintiff for withdrawal of the suit under Order XXIII Rule 1 CPC) 3.

I.A. 41682/2024 is an application filed by the plaintiff under Order XXIII Rule 1 Code of Civil Procedure, 1908 ('CPC') to withdraw the present suit in view of the settlement agreement dated 30.09.2024 executed between the parties.

Learned counsel for the non-applicant/defendant confirms the execution of the aforesaid settlement agreement and states that he has no objection to the said withdrawal.

Interim orders stand vacated. The registry is directed not to list this suit any further.

All future dates stand cancelled.
