By way of the present petition, the learned counsel for the petitioner seeks modification of order dated 09.01.2025 passed in Criminal Appeal No. 02/2025, passed by the learned Additional Sessions Judge (ASJ), New Delhi, Patiala House Court, whereby the application filed by the petitioner/accused under Section 430(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter 'BNSS') in a pending appeal against his conviction under Section 138 of the Negotiable Instruments Act, 1881, was allowed on the ground of depositing 20% of the fine /compensation. 4.

condition of the petitioner herein is as such that he is not able to deposit 20% of the fine/compensation amount imposed by the learned ASJ vide order dated 09.01.2025.

Considering the overall facts and circumstances of the case, the order dated 09.01.2025 is modified to that extent that petitioner is allowed to deposit 15% of the fine/compensation amount instead of 20% as imposed vide order dated 09.01.2025.

In view of the above, the present petition along with pending application stands disposed of.
