The present petition has been filed by petitioner, who, till recently, was posted as a Deputy Commandant, Central Reserve Police Force (CRPF) 220 Battalion and was last posted in Rohtak, Haryana, praying inter alia for quashing of the order dated 7th December, 2015 issued by the respondent No.2 and the order dated 4th January, issued by the respondent No.3, transferring him from 220 Battalion to 2nd Battalion, CRPF with immediate effect and calling upon him to join the new place of posting within ten days.

After lengthy arguments were addressed by learned counsel W.P.(C) 259/2016

for the petitioner in the pre-lunch session, when we had expressed our disinclination to interfere with the impugned orders, learned counsel for the petitioner had sought a pass-over to enable him to obtain instructions from his client if he was willing to immediately report to his place of transfer, if granted two days' time. 3.

In the post-lunch session, learned counsel for the petitioner states that as per the impugned order dated 4th January, 2016, the petitioner was required to report to 2nd Battalion CRPF by today, but he is indisposed and unable to travel. He stated that he has obtained telephonic instructions from his client to the effect that he does not wish to press the present petition and would be in a position to report to his new place of posting by 18th January, 2016.

In view of the aforesaid submission made by learned counsel for the petitioner, the petitioner is granted time upto 18th January, 2016 to report to the place of posting at Sukma, Chhattisgarh. 5.
