O R D E R

% 17.05.2016 Learned counsel for the petitioner submits that during the consolidation proceeding, petitioner was allotted 1 bigha 4 biswa of land in the plot bearing no. 556(1-4), Village Deoli, Delhi. However, the possession of only 17 biswa was given. Accordingly, petitioner approached before the Financial Commissioner by way of revision, which was registered as case no. 23/96-CA.

Vide order dated 8th March, 1996, Financial Commissioner disposed of the revision and case was remanded back to the Consolidation Officer with the directions that deficiency of the petitioner's land be made good without disturbing the settled allotment of other right

holders and after notice/hearing the concerned persons. After the remand, proceedings started before the Tehsildar/Consolidation Officer (respondent no. 1) in case no. 2/CO/1996. However, no substantial progress was made in the case. Therefore, petitioner approached this Court by way of WP(C) No. 1264/2007, which was disposed of vide order dated 1st March, 2007. Respondent no. 1 was directed to dispose of the case no.2/CO/1996 within a period of three months.

Learned counsel submits that despite the order passed in WP(C) No. 1264/2007, respondent no. 1 has yet not decided the case of petitioner till date.

Respondent no. 1 is present in person. He submits that case could not be decided since petitioner did not cooperate and file relevant documents in the matter. He assures that case of the petitioner would be decided within three months.

Accordingly, it is ordered that petitioner shall cooperate and participate in the proceedings on the dates fixed in the matter by the respondent no. 1 and also produce relevant documents. Respondent no.1 is directed to dispose of the matter expeditiously and preferably in 3 months.

Petitioner shall appear before the respondent no. 1 on 23rd May, 2016 at 3:00 PM and on subsequent dates fixed in the matter. Writ petition is disposed of in the above terms. A.K. PATHAK, J.
