OMP(I) (Comm) 38/2019 This petition under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioners seeking certain interim reliefs. Counsel for the respondent who appears on an advance notice submits that the respondent has no objection to the appointment of an Arbitrator.
In view of the above, I appoint Mr.Padam Kant Saxena, ADJ (Retd.) Delhi, (R/o Flat No. 261, Royal Residency, Plot No. 5, Sector9, Dwarka, New Delhi- 110077 Mobile-9910384668) as a Sole Arbitrator.
The Arbitrator shall give disclosure under Section 12 of the Act before proceeding with the reference.
The petitioners shall be at liberty to file an application under Section 17 of the Act before the Arbitrator so appointed. Keeping in view the urgency in the reliefs claimed, the Arbitrator is requested to have the first hearing of the arbitration proceedings on 11th February, 2019 at 4.00 p.m. at the Bar Office, Delhi High Court.
