IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 253/2020 SIMRAN @ MEENA KHAN ..... Petitioner Through Mr Madhav Khurana, DHCLSC with Ms Aarushi Singh, Advocates.

versus STATE ..... Respondent Through Mr Sanjay Lao, ASC for State with SI Amit Dutt, P.S. Lajpat Nagar.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 24.02.2020 1.

The petitioner has been produced in Court on production warrants. The production warrants are discharged.

2.

The petitioner has filed the present petition, inter alia, impugning an order dated 17.12.2019, whereby the petitioner's application for parole was rejected in terms of Rule 1210 (V) of the Delhi Prison Rules, 2018. The said rule requires that a minimum period of six months ought to have elapsed from the date of surrender on the conclusion of the previous parole. 3.

The nominal roll indicates that the petitioner had been released on 12.03.2019 and had surrendered on 10.05.2019. The petitioner had filed an application for parole on 07.10.2019. Thus, this Court finds no infirmity with the impugned order inasmuch as, a period of six months had not elapsed from the date of her surrender. However, it is noticed that the said period has since elapsed.

4.

In view of the above, the present petition is disposed of with liberty to the petitioner to file afresh. It is directed that if any such application is moved, the same would be considered in accordance with law. VIBHU BAKHRU, J FEBRUARY 24, 2020 pkv
