The accused/applicant seeks regular bail in case FIR No. 328/2025 of PS Crime Branch for offence under Section 20/29 NDPS Act. 2.

Broadly speaking, according to prosecution case, 366 grams charas from the accused/applicant and 977.5 gram charas from co-accused were recovered and the total recovery becomes the commercial quantity. In this regard, prosecution contends that charge under Section 29 NDPS Act is made out. This contention of prosecution is strongly disputed by learned counsel for accused/applicant, who claims that even according to prosecution case, the alleged recovery from the accused/applicant was nearing small quantity.
