The Petitioner has approached this Court challenging the Order dated 24.02.2024 by which the Petitioner's application for extension of Visa has been closed. The Petitioner has also prayed for a direction to Respondent Nos.2 and 3 to allow the Petitioner to stay in India for another period of 30 days on his VISA No.901B257BN.

The Petitioner had come to India on a tourist Visa in the month of October, 2022. It is stated that the Petitioner was defrauded by certain persons and, thereafter, he filed a complaint before the EOW. It is stated that the visa of the Petitioner is valid till 12.09.2024. Though the Visa of the Petitioner is for a period of 180 days but the total stay in India cannot exceed W.P.(C) 3168/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 90 days at one time, and therefore, the Petitioner has to exit the country by 10.03.2024.

Ms. Nidhi Raman, learned CGSC appearing for the Respondents, contends that the Petitioner can go out of country and can re-enter the country and stay here for a further period of 90 days from the date of arrival or till 12.09.2024 from the date of his arrival in the country whichever is earlier.

In view of the above, the Petitioner can definitely go out of the country and re-enter the country again without any impediment since the Petitioner can stay in the country for 90 days from his arrival or till 12.09.2024 from the date of his arrival in the country whichever is earlier. 5.
With these observations, the writ petition is disposed of, along with pending application(s), if any.
