The learned Counsel for the Parties submit that the Parties have arrived at a Settlement and it is agreed between the Parties that Respondent Nos. 1 and 2 shall apply for cancellation of its Trade Mark 'MAGGISUN' registered vide Registration No. 1163623 in Class 21 and accordingly this Petition may be allowed.

In view of the above, in terms of the Settlement arrived at between the Parties, it is directed that Respondent No. 3 shall cancel / remove the Trade Mark 'MAGGISUN' registered vide Registration No. 1163623 in Class 21 within a period of eight weeks.

In view of the above, the present Petition is allowed with the aforesaid direction.
