CRL.M.C. 719/2019 & CRL.M.A. 2966/2019 Impugned order of 7th January, 2019 directs issuance of nonbailable warrants against petitioner to secure his presence. Learned counsel for petitioner assails the impugned order on the ground that petitioner has not been named in the charge sheet and his name figures in the supplementary charge-sheet and issuance of nonbailable warrants is not justified. Upon hearing, the order of 7th January, 2019 is modified to the extent that instead of non-bailable warrants, bailable warrants be issued against petitioner.

In any case, if non-bailable warrants have already been issued, then it be not executed, as it has been undertaken on behalf of petitioner that petitioner would be appearing before the trial court on the date already fixed i.e. 6th March, 2019.
In light of the aforesaid, this petition and application are accordingly disposed of.
