O R D E R
% 28.02.2020 Petitioner is in custody in FIR No. 280/2012, registered at police station Khyala, Delhi for committing offence under Section 302/34 IPC. Vide this petition, petitioner is seeking parole for three months to attend the marriage of his sister, which is scheduled for 12th March, 2020 and for filing Special Leave Petition.
In terms of last order, status report dated 28th February, 2020 has been placed on record and factum of marriage of his sister on 12th March, 2020 stands verified. Learned Additional Standing Counsel has drawn attention of this Court to Nominal Roll dated 24th February, 2020 placed on record, wherein it is stated that co-accused Swarn Kanta is presently on interim bail of four weeks vide order of 31st January, 2020 of this Court. It is submitted by learned Additional Standing Counsel that petitioner be released on parole for one month only after co-accused Swarn Kanta surrenders before the competent authority. Heard.

In view of the above, this application is allowed and in the interest of justice, petitioner is granted parole of one month from the date of his release on his executing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the learned trial court, subject to following conditions:
i) The petitioner shall be released on parole for one month only after co-accused Swarn Kanta surrenders before the competent authority;
ii) The petitioner shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working conditions at all the times. The same shall not be changed without prior intimation to the Jail Superintendent;
iii) The petitioner shall report to the concerned Station House Officer (SHO) on every Monday at 11:00 a.m. during the period of parole;
iv) The petitioner shall duly surrender at the end of the period of parole; and iv) The petitioner shall also not indulge in any criminal activity while on parole.
A copy of this order be communicated to the Jail Superintendent. The application stands disposed of accordingly. Dasti.
