O.M.P.(I) (COMM.) 40/2019 This petition under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking certain interim reliefs.

I have, by a separate order passed today in ARB.P. 92/2019 titled Rajeev Bairathi vs. Almond Infrabuild Private Limited, appointed an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Memorandum of Understanding dated 27.03.2014. In view of the above, the present petition is disposed of granting liberty to the petitioner to file an application under Section 17 of the Act before the Arbitrator seeking similar or other reliefs.

The Arbitrator is requested to immediately take up this application for hearing upon being filed.

The learned counsel for the respondent is present in Court. The date before the Arbitrator is therefore being fixed in his presence. It is informed by the counsel for the petitioner that the Arbitrator appointed has given his consent telephonically for conducting the first arbitration hearing on Monday, 11th February, 2019 at the Bar Office, Delhi High Court at 4:00 p.m.
