% 08.02.2019 The petitioner seeks parole for treatment of his minor son, who is suffering from abdominal bleeding. He was earlier granted parole in W.P. (Crl.) 165/2019, but he has been unable to avail the said parole because of pendency of FIR No. 83/2011 registered at Police Station, Special Cell-NDR, Lodhi Colony. The application for parole in the said FIR has been rejected by the GNCTD vide order dated 07.02.2018 on the ground that he has involved in five other similar cases of dacoity and attempt to murder, which are pending adjudication. Since these aspects have already been considered by the Court in the previous order, keeping in view the medical exigency of his minor child and the need of presence of the father/the petitioner for the minor's urgent medical care, the aforesaid order of GNCTD is set aside and the petitioner is granted parole for a period of four weeks from the date of his release, on the same terms
and conditions, as applicable for his parole vide order dated 22.01.2019 in W.P.(Crl) 165/2019.
The petition stands disposed-off in the above terms. A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. Additionally, a copy be served to the Jail Superintendent concerned through the police. NAJMI WAZIRI, J FEBRUARY 08, 2019/RW
