The present petition assails the Order dated 24.09.2024 passed by the learned Presiding Officer, Debt Recovery Tribunal-II ("DRT") in TMA no. 5 of 2023 (hereinafter referred to as "Impugned Order"), whereby, the learned DRT dismissed the said application filed by the Petitioner herein. The petitioner further assails the decision dated 14.01.2026 whereby Praecipe No. 11/2026 moved by the petitioner was dismissed. The learned counsel for the petitioner submits that he has already filed an appeal, being Appeal no. 264/2024, assailing the Impugned Order before the learned Debt Recovery Appellate Tribunal (DRAT). However, the same has not been taken up for hearing and is still pending for adjudication. 5.

The learned counsel for the petitioner submits that petitioner herein had also moved a Praecipe bearing no. 11/2026 seeking urgent hearing of the appeal which was dismissed and the intimation was received by an email dated 14.01.2026.

As the above Impugned Order is still under challenge before the learned DRAT and in view of the limited relief sought by the petitioner with regard to urgency in the matter, the petitioner is permitted to move an appropriate urgency application w before the concerned DRAT. 7.

As soon as the urgency application is filed, we expect that the concerned DRAT to consider and decide the said application expeditiously, after hearing the parties, by a reasoned order, without granting any unnecessary adjournments.

In view of the aforesaid, the present petition along with pending applications, if any, is disposed of.
