The present petition has been filed assailing the summoning order dated 12.01.2023 passed by the Court of learned Metropolitan Magistrate01, Patiala House Courts, New Delhi in CC No. 15/2021 and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. Mr. Tarang Srivastava, learned APP for the State accepts notice. He submits that since the complaint is an outcome of a property dispute and the parties have arrived at a settlement, the State has no objection in case the complaint in question is quashed. 3.

The petitioner no.1, who was mother of other parties, i.e., petitioner nos. 2 and 3 and respondent no.2 have passed away. The petitioner nos.2 and 3, as well as, respondent no.2, who are present in Court, have been identified by their respective counsels.

The facts as articulated in the present petition are that certain differences arose between the family members of Late Sh. Tarlok Singh Anand, a MoU was entered between the petitioners and the respondent no.2/complainant dated 22.05.1992, whereby the respondent no.2/complainant and his wife took their share from the pool of properties and assets and severed all their ties with the rest of the family members. Later, respondent no.2 filed a complaint case. 6.
During pendency of the present proceedings, this Court vide order dated 24.03.2023 referred the parties to the mediation. 7.
The learned counsel for the parties apprise the Court that the parties have arrived at a settlement in the mediation, terms whereof have been reduced into writing in the form of Settlement Agreement dated 30.10.2025. The said settlement agreement has been received from the Delhi High Court Mediation and Conciliation Centre and is on record. As per the said settlement, the parties apart from agreeing on other terms with regard to the family property, have agreed to have the complaint in question quashed. 8.
The complainant, who has been arrayed as respondent no.2, is present in Court. On being queried by the Court, he affirms the factum of settlement and state that he has no objection in case the complaint is quashed. 9.
Likewise, the petitioner nos. 2 and 3 are also present in Court and they have also affirmed the factum of settlement. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The parties have also undertaken to comply with all the terms and conditions of the settlement. The statement is taken on record. 11.
In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present complaint and all the other proceedings emanating therefrom be quashed. 13.
Consequently, the petition is allowed and the Complaint Case No. 15/2021, alongwith all other proceedings emanating therefrom, is quashed. 14.
The petition stands disposed of in the above terms. 15.
