By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of the FIR No.406/2023 dated 01.07.2023 registered at PS.: Palam Village under Section 498A/406/354/377/34 of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom, since the petitioner no.1 and the respondent no.2 have settled and dissolved all their disputes and differences in front of their relatives as also have started to reside with each other since 09.10.2025. The present petition is accompanied with the proofs of identity of the petitioners and respondent no.2.

Issue notice. Learned APP for the State accepts notice, and submits, that he has no objection to the quashing of the aforesaid FIR. 3.

that she has voluntarily settled all her disputes with the petitioner no.1, and she does not wish to pursue the criminal proceedings against the petitioners and has no objection if the present FIR is quashed. 4.

The petitioner no.1 and the respondent no.2, present in Court, as well as their credentials, as on record, have been identified by the IO. 5.

Facts disclose that the parties have voluntarily arrived at a mutual oral settlement in front of their relatives, and in fact, have started residing together/ with each other since 09.10.2025 and have also filed their respective affidavit(s) along with the present petition to that effect. Thus, considering the same and following the law laid down by the Hon'ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, continuation of the aforesaid FIR against the petitioner will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.406/2023 dated 01.07.2023 registered at PS.: Palam Village under Section 498A/406/ 354/377/34 of the IPC and all proceedings emanating therefrom are hereby quashed.

Accordingly, the present petition, alongwith the pending application, is disposed of in the aforesaid terms.
