Despite the order dated 03.07.2019, and further orders, no application for amendment of the suit has been filed. The costs in terms of the order dated 15.10.2019 have been paid by the plaintiff. 2.
Mr. Saurabh Seth, learned counsel for the plaintiff seeks leave to withdraw this suit with liberty to file a fresh suit for damages based upon the same contract.
