A Petition under Section 482 Cr.P.C has been filed on behalf of the Petitioner for quashing of the Order dated 15.01.2021 vide which the learned Spl. Judge has granted bail to the Respondent No.2 in FIR No.508/2020 under Section 328 and 376(2)(n) IPC P.S. Kalyan Puri. 2.

Essentially, the grounds of challenge were that there were serious allegations under Section 328 and 376(2)(n) IPC which involves imprisonment of a term not less than 10 years. The investigations were still at the nascence stage when the Bail has been granted. The Chargesheet was yet to be filed and thus, a prayer is made to recall the Order of grant of Bail. Learned APP submits that since then the Chargesheet got filed and the entire evidence has been concluded and the matter is now pending at the stage of pronouncement of judgment. There is no averment that since the date of grant of Bail, there was any kind of threat on misuse of the Bail. 4.

Considering the totality of circumstances, the present Petition has essentially become infructuous and is accordingly disposed of along with the pending Application.
