% 11.02.2019 CM No. 6248/2019 Exemption allowed subject to all just exceptions. CM(M) 228/2019 and CM No. 6247/2019 Initial submissions have been made on behalf of the petitioner. Inter alia, reliance is placed on behalf of the petitioner on the proceedings dated 21.12.2018 in Country Colonizers Pvt. Ltd. v. Dalvir Kaur (annexed as annexure P-9) submitting that it relates to the similar impugned order therein.

Inter alia, reliance is also placed on behalf of the petitioner on the proceedings also dated 21.11.2017 in CM(M) 953/2017 case titled as Prem Lata Sanghi & Ors. v. Deutshe Lufthansa Aktiengesellschaft (Lufthana German Airlines) & Anr. submitting to the effect that the present petition would be maintainable.

Notice of the petition and the accompanying application be issued to the respondent on taking of steps by the petitioner through all permissible modes including approved courier with the tracking report being placed on record, returnable on 18.2.2019 on which date the proceedings in these matters and the other matters on the aspect of maintainability of the petition before this forum are fixed. In the meantime, subject to the deposit of an amount of Rs.27,99,827/- with the Registrar General of this Court in the form of an FDR by 15th February, 2019, the operation of the impugned order would stand stayed.
