W.P.(CRL) 273/2020 2.

The petitioners have filed the present petition, inter alia, praying that FIR No.1074/2018 under Sections 498A/406 of the IPC registered with PS Uttam Nagar and all proceedings emanating therefrom, be quashed. 3.

The said FIR was registered at the instance of respondent no.2. Respondent no.2 is present in the Court and she is identified by the Investigating Officer. She states that she had filed the said FIR pursuant to matrimonial disputes that had arisen between her and her husband

(petitioner no.1). She states that she has since resolved her all disputes with her husband and they have been living amicably together since 25.02.2019. She joins the petitioners in praying that the FIR in question be quashed and she no longer wishes to pursue any proceedings against them. 4.

The petitioners are present in the Court and is identified by their counsel. Petitioner no.1 undertakes to this Court that his conduct towards respondent no.2 is cordial and he shall, under no circumstances, indulge in any violence with respondent no.2.

In view of the statement made by respondent no.2 and the undertaking given by petitioner no.1, this Court considers it apposite to allow the present petition.

Accordingly, FIR No.1074/2018 under Sections 498A/406 of the IPC registered with PS Uttam Nagar and all proceedings emanating therefrom, are quashed.

The petitioners and respondent no.2 shall sign this order as an acknowledgment of their statements recorded herein. 8.
