% 02.06.2016 Mr. Rustagi, learned counsel appearing on behalf of the applicant seeks leave to withdraw this application at this stage, with liberty to approach the trial court afresh, once charges in the subject charge sheet have been framed. Leave and liberty granted.
However, in view of the constitutional imperative, as enunciated by the Hon'ble Supreme Court of India in a catena of decisions, that every accused is entitled to a speedy trial, particularly when his personal liberty is circumscribed, the trial court is requested to hear the submissions on behalf of the applicant seeking discharge, on the next date of hearing before the trial court i.e. on 09.06.2016 and make a determination thereon, in accordance with law, as expeditiously as possible.
Liberty is however, reserved to the applicant to approach this Court afresh, if charges in the subject FIR are not framed expeditiously. The application is dismissed as withdrawn and disposed of accordingly. SIDDHARTH MRIDUL, J JUNE 02, 2016/dn
