% 11.02.2019 The petitioner alleges that unauthorised construction is going-on in the subject property in Sangam Vihar, New Delhi. The petitioner seeks a direction to demolish the alleged unauthorised construction in the subject property.
At the outset, learned Standing Counsel for respondent No. 1/SDMC submits that the property that is subject matter of this petition has been inspected by respondent No. 1; and it was found that only a boundary wall was being constructed on vacant land and no building construction was being undertaken therein.
She states that since there was no permission for constructing the boundary wall, the same was stopped by issuance of a stop-work notice dated 07.02.2019; and communication was also sent to the concerned SHO to keep vigil so that construction of the boundary wall is not re-commenced.
Before proceeding further with the matter, the petitioner is directed to file photographs of the subject property to show what unauthorised construction, if any, is being undertaken in the property, within two weeks under an affidavit.
