Applicant seeks anticipatory bail in FIR No. 0064/2026 dated 04.02.2026, registered at P.S. Amar Colony, for commission of offences under Section 376 IPC and Sections 69/89 Bharatiya Nyaya Sanhita, 2023, (BNS). 2.
When the matter was taken up by this Court on 18.03.2026, the following facts were recorded:- "2.
According to learned counsel for applicant, the parties were in a consensual love-relationship which, eventually, turned sour and there is no criminality involved in the allegations made by the complainant and, moreover, whatever was done was with her own will and volition. 3. Learned APP for State appears on advance notice and accepts notice. 4.
Learned counsel for complainant also appears on advance notice and would be at liberty to file reply by the next date of hearing with advance copy to the other side.

Learned counsel for applicant submits that earlier also, when the application was pending adjudication before the learned Court of Sessions, on direction, the applicant had joined the investigation. Learned APP for State, however, submits that the mobile phone of the applicant has not been handed over to the police and, moreover, warrants have been issued against him.

Learned counsel for applicant volunteers to hand over the mobile phone to the concerned IO within two working days from today. 8.
Let no precipitative steps be taken against the applicant, on his submitting his mobile phone within two working days from today." 3.
Learned Addl. P.P. for the State submits that in terms of the abovesaid directions, the applicant has already joined investigation and his mobile device has also been seized. He submits that even charge-sheet has been submitted before the learned Magisterial Court, which is yet to take any cognizance and the next date before the learned Magisterial Court is 02.05.2026. 4.
Learned counsel for the complainant has also joined the proceedings through video-conferencing and prosecutrix is also present in person. 5.
Keeping in mind the overall facts of the case and the fact that the applicant has already assisted the Investigating Agency and even charge-sheet has been filed, the interim order dated 18.03.2026 is, hereby, made absolute and the applicant is directed to appear before the learned Magisterial Court on the abovesaid fixed date and to submit personal bond and surety bond in a sum of Rs.25,000/- each. The bail would be subject to the condition that he would not come in contact of prosecutrix, directly or indirectly and would appear before the learned Trial Court on each and every fixed date and would not leave the country, without prior permission of the learned Trial Court. 6.
The application is, accordingly, disposed of. 7.
Pending applications also stand disposed of.
