The learned counsel appearing for the petitioner seeks to withdraw the present petition, with liberty to file afresh assailing the Constitutional validity of the provisions of Section 164 of the Companies Act, 2013. 3.

The petition is dismissed as withdrawn with the aforesaid liberty. The pending application is also disposed of.
