The present petition has been filed by the petitioner with the following prayers:- "In view of the facts and circumstances narrated above it is therefore, prayed that this Hon'ble Court may kindly be pleased to issue:

a) Writ, order or Directions Under Article 226 Of The Constitution of India in the Nature of Mandamus and thereby direct the respondent no. 1 and respondent no. 2 to demolish the illegal construction and to take legal action against respondent no. 3 who has been raising illegal

construction on the property bearing no. 64-A, Front portion (earlier Central Bank), Main Chowk Badarpur, New Delhi110044, in violation of NDMC Act, 1994 in the interest of justice.

b) Any other appropriate writ, order or direction which is necessary in the facts and circumstances of this case." 2.

Learned counsel for the respondent No.3 states that the respondent has approached Appellate Tribunal, MCD in an appeal being No.434/2019 against the demolition order and a stay has been granted by the said Tribunal. If that be so, liberty is with the petitioner to file an application seeking intervention before the Tribunal. The writ petition is closed. CM Nos. 6424/2019 & 33316/2019 Dismissed as infructuous.
