% 06.01.2016 This is a suit for dissolution of partnership and rendition of accounts having jurisdictional value less than rupees two crores. It is also informed by ld. counsel for plaintiff that the instant suit does not fall within the category of Commercial suits.
It is further submitted by ld. counsel for plaintiff that the partnership deed which is sought to be dissolved by way of the instant suit is situated within the territorial jurisdiction of Central District. Ld. counsel for defendant on the other hand informs that the defendant resides and works for gain within the territorial jurisdiction of South District. This court is of the opinion that that matter ordinarily has to be transferred at the place where the defendant works for gain.
Accordingly, keeping in view of notification no.27187/DHC/Orgl. dated 24.11.2015 & in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), the present matter stands transferred. Parties are directed to appear before the Court of Ld. District & Session Judge (South District), Saket Courts, Delhi on 11th February, 2016. S.S.
