O R D E R

% 26.02.2020 The learned counsel for the petitioner submits that the husband of the petitioner has expired. He prays for leave to withdraw the present petition with liberty to avail such other remedy as may be open to the petitioner in law.

Leave as prayed is granted.

In the order dated 29.01.2020, the respondent no. 3 was called upon to disclose the current state of affairs of the Cobalt Therapy Machine, that the petitioner claims was not working and because of which the husband of the petitioner was referred to the other hospitals. The respondent no. 3 in its

affidavit (though not on record) has stated as under:- "That in response to the direction of Hon'ble High Court of Delhi vide its order dt. 29.01.2020, it is submitted by the answering respondent that the old Cobalt Therapy Machine which was shut down for repairs in the month of November-2019 could not be restarted because of technical issue. A new Cobalt Therapy Machine has been procured and will be installed and become functional within two months (Approx.) since as per guidelines of Atomic Energy Regulatory Board the new machine can only be installed after the old one is decommissioned. Hence, it is taking two months to install it." Binding the respondent no. 3 to the aforementioned statement and, infact, directing the respondent no. 3 to expedite the process of installing the new machine, the present petition is disposed of.
