Mr. Brahme, advocate, appears on advance notice on behalf of the respondents.

2.1 Learned counsel does not dispute that parties are already in Court by virtue of a petition preferred under Section 9 of the Arbitration and Conciliation Act, 1996 (for short '1996 Act') filed by the petitioners. 3.

To be noted, this petition has been filed by the petitioners before the Additional District Judge-04 (South), Saket Courts, New Delhi. 4.

In these circumstances, learned counsel for the respondents, says that he would have no difficulty in this Court appointing an Arbitrator in the matter.

Mr. Madan, learned counsel for the petitioners, submits likewise. 6.

Accordingly, Mr. Babu Lal, former ADJ, Delhi (Mob. No.: 9910384643) is appointed as an Arbitrator in the matter. 7.

The learned Arbitrator will be paid his fee as per the provisions of the Fourth Schedule appended to the 1996 Act.

The learned Arbitrator will file a declaration under Section 12(5) read with the attendant provisions of the 1996 Act before entering upon reference.

9.

The petition is disposed of with the aforesaid terms. 10.
